Denise Richards has submitted photo evidence to support her claims that her estranged husband Aaron Phypers and his family trashed her Calabasas home.
Amid the exes’ messy ongoing divorce, Richards, 54, filed a complaint requesting that the court order Phypers, 52, and his family to vacate the property where he was residing with his parents and brother.
Included in the Aug. 19 filing obtained by PEOPLE, were photos that allegedly portrayed the state of the home when she visited it on Aug. 3 to retrieve some of her belongings. Richards alleged in the filing, “Aaron and his parents and brother have severely damaged the [property] and left the house in a state of disarray.”
In one of the images attached as evidence, part of the flooring appears to be removed in one of the bedrooms, with boxes, articles of clothing and papers scattered around the space.
"We had to rip up the carpet because you couldn't breathe in the room, it was that disgusting. I had my brother rip up carpet because it was super saturated with piss and fecal matter," Phypers says in a statement to PEOPLE. Richards' dogs have been living in the home with his parents.

"It was a biohazard. We were hoping to replace everything," he adds.
Another image shows a similar scene in what appears to be a living room with a sofa pushed towards the wall, while additional items seem to be out of place and tossed on the floor.
In another shot, the flooring can be seen completely torn out of a hallway as papers and other debris remain on the ground.
“I was shocked at the condition of the home, having not lived there for over two years," she said in the filing.
Richards also claimed Phypers had not been paying rent, and eviction proceedings were to begin on Aug. 23.
She specified that she entered the home on Aug. 3 when she knew Phypers wouldn’t be there, as that would violate the temporary restraining order she had against him.
"It was 10 times worse than what you see now in those pictures," Phypers says. "That's all her stuff, by the way. Those are all her boxes of clothes, which my mom took off the floor and tried to hang it up in wardrobe boxes. Denise has abandoned everything."

Per the filing, Richards alleges that while she and Phypers are both named on the lease, she moved out two years ago so her estranged husband’s family could live there. During the process, she claims she left “many of my personal items and my late mother's items" at the house.
The property is where she and Phypers lived during their marriage, and Richards claims she was under the impression they would be moving back in once his family moved back to Canada.

In response to Richards’ allegations, a source close to Phypers claimed the filing was an attempt “to divert attention away from her adulterous affair.”
“We thought all these shenanigans were being dropped from courts,” the source continued, adding that "Denise’s immediate interest in trying to get into the residence Aaron lives in is not only suspicious, but manipulative.”
The insider also alleged Richards “previously agreed to a swap of personal property with Aaron for July 16th when the movers were surprisingly turned away,” adding, “She has kept all personal, business, and third-party equipment from Phypers, leaving him with only a shirt on his back for the last 50 days.”
Phypers says he still does not have any of his belongings. "I don't have any of my clothes. I don't have any money, I've been trying to sell little bits here and there. I don't have my equipment to do my trade."
He concludes, "I don't have anything. I had to borrow a shirt and tie from my buddy to even present myself at court on a Zoom feed."

After six years of marriage, Phypers officially filed for divorce from Richards on Monday, July 7, citing “irreconcilable differences." The exes, who wed in 2018, separated on July 4, according to Phypers’ divorce filing.
In the days after the filing, Richards claimed Phypers physically abused her on multiple occasions, and she was later granted a temporary restraining order against him. In a previous statement to PEOPLE, Phypers denied the allegations of physical abuse and called them "completely false and deeply hurtful."
